01The agreement
These terms are a contract between you (the workspace and its members) and MailFleet. Creating a workspace or using the service means you accept them. If you're accepting for a company, you confirm you have authority to bind it.
02The service
MailFleet sends email sequences from mailboxes you connect, warms those mailboxes, stops sequences when people reply, and collects replies into one queue. We may improve or change features; if a change materially reduces the service, you can cancel and receive a pro-rata refund of prepaid fees.
03Your account
- Keep your sign-in credentials secure; you're responsible for activity in your workspace.
- Provide accurate account and billing information.
- One person per seat — shared logins may be converted to seats.
04Sending rules — the part that matters
Cold outreach lives on shared reputation. Using MailFleet, you agree to:
- Comply with the laws that apply to your recipients — including CAN-SPAM, GDPR/PECR, CASL — and identify yourself truthfully in every email.
- Email only people you have a lawful basis to contact. No purchased or scraped lists without one.
- Honor every unsubscribe and objection — the product enforces suppression automatically, and removing that behavior is prohibited.
- No deceptive subject lines or headers, no malware, no illegal, fraudulent or harassing content.
Campaigns that cross bounce or complaint thresholds pause automatically. Workspaces that repeatedly or egregiously break these rules can be suspended immediately — shared infrastructure comes first.
05Your data
You own your lead lists, email content and results. You grant us the license needed to store, process and transmit them to run the service — nothing more. Our Privacy Policy describes processing in detail and is part of these terms.
06Connected mailboxes
You confirm you're authorized to send from every mailbox you connect. Your email provider's own terms apply alongside ours, and provider-imposed limits (daily caps, API quotas) constrain what MailFleet can send.
07Trial & billing
- 14-day free trial, no card required. Paid plans bill monthly or annually in advance.
- Plans meter sent emails, stored leads and connected mailboxes; overages prompt an upgrade, never surprise charges.
- Cancel anytime from Settings — service runs to the end of the paid period. Fees are non-refundable except where these terms or the law say otherwise.
08Suspension & ending the agreement
You can close your workspace at any time. We can suspend or terminate for breach of these terms — for sending-rule violations, effective immediately; otherwise with 14 days' notice. After closure you have 30 days to export your data before deletion.
09Disclaimers
The service is provided "as is". Deliverability depends on factors we don't control — recipient filters, your content, your list quality — so we don't guarantee inbox placement, open rates or replies.
10Liability & indemnity
Neither side is liable for indirect or consequential damages. Our total liability is capped at the fees you paid in the 12 months before the claim. You'll indemnify us against claims arising from your content, your lists, or your breach of the sending rules in section 04.
11Changes & governing law
We may update these terms; material changes are emailed to workspace owners 14 days in advance, and continued use after that is acceptance. These terms are governed by the laws of Delaware, USA, with disputes resolved in its courts.
